NO PURCHASE NECESSARY TO ENTER OR WIN, VOID WHERE PROHIBITED.
Registration and participation by developers in the 100 Apps in 100 Days Challenge, Powered by TopCoder (the “Competition”) constitutes agreement with these terms and conditions (“Rules” or “Terms and Conditions”) between you (“You” or “Participant”) and TopCoder, Inc. (“TopCoder”).
GENERAL
This skill-based Competition is brought to you and is sponsored by TopCoder. This Competition is designed to encourage the development and use of certain technologies, and provides an opportunity for members of the TopCoder Community to create an original application using Alcatel-Lucent’s APIs and the APIs documented on the Programmable Web website (“Specified Technology”). TopCoder and Alcatel-Lucent (the “Corporate Participant”) invite You and by making a submission You agree to submit entries for prizes to be awarded by the Competition judges in accordance with these Terms and Conditions. This Competition is governed by the laws of the United Statesand the State of Connecticut, and You hereby consent to the exclusive jurisdiction and venue of the courts in Hartford,Connecticut (state and federal) for any causes or controversies arising out of participation in this Competition.
If You do not agree to abide by these Terms and Conditions, please do not participate in this Competition.
OVERVIEW
The Competition is designed to encourage the development and use of the Specified Technology. Participation in the Competition is limited to registered members of the TopCoder Community. The Competition is not open to non-members or to the general public. Those wishing to learn more about the TopCoder Community can find more information at: http://www.topcoder.com.
TopCoder and the Corporate Participant reserve the right to limit the participation of any person in the Competition, amend or interpret the Terms and Conditions or official communications governing the Competition or cancel the Competition for any reason with prior notice. Notices for any such amendment, interpretation or cancellation will be deemed to have been given by posting on the TopCoder website and by virtue of Your continued participation in the Competition. You may terminate participation in the Competition upon written notice to TopCoder.
ELIGIBILITY
The Competition is open to all members of the TopCoder website, who have agreed to the terms thereof, and who are at least 18 years of age as of the date You register for the Competition. Competitors must be (i) a U.S. citizen, (ii) a lawful permanent resident of the U.S., (iii) a temporary resident, asylee, refugee of the U.S., or have a lawfully issued work authorization card permitting unrestricted employment in the U.S., (iv) a non-U.S. resident authorized in the country in which the member resides while participating in the Competition to perform services as an independent contractor; or (v) be in the United States under a valid and current visa issued by the United States government which does not prohibit receiving a cash prize.
A Competitor is not eligible for the Competition if he/she is a resident of the Quebec province of Canada. Prizes will not be paid to residents of Iran,Cuba, North Korea, Sudanor Syria. In addition, a Competitor is not eligible for the Competition if the Competitor is on the Specially Designated National list promulgated and amended, from time to time, by the United States Department of the Treasury.
All Competitors must be registered members of TopCoder, and must have agreed to these Rules prior to and as a condition for registering and participating in the Competition.
Competitors must abide by the Terms of Use of TopCoder’s website at www.topcoder.com. Violation of the Terms of Use may result in disqualification from the Competition, and/or further consequences as determined in TopCoder’s sole discretion.
Current employees of TopCoder and Corporate Participant and those involved in the development, production (including prize suppliers and sponsors), implementation and distribution of the Competition and their advertising or promotion agencies, parent companies, service providers, agents, officers, subsidiaries or affiliates, or any other persons or entities directly associated with the Competition and members of their immediate families and/or persons living in the same household as such persons, are ineligible to enter the Competition.
If You are a minor in the country or state in which you reside we will award the prize to your parent or legal guardian, who must sign all documents required under these Rules.
If You are a winner and You (i) do not reply to such notification or the notification is undeliverable, (ii) do not return promptly any required documentation, or (iii) are not otherwise in compliance with these Rules, You will be disqualified and forfeit any prize, and we may, at our discretion, select and notify another participant.
All federal, state and local laws and regulations apply. Void where prohibited.
HOW TO ENTER:
To participate, You must:
- Be a TopCoder Community member by registering at http://www.topcoder.com/reg/
- Develop an application that uses the Specified Technology.
- Submit your entry no later than the Competition End Date.
- Submit documentation in English. (The application itself does not need to be in English.)
You may enter as many applications as you like, however, You may enter each application only once. Applications submitted multiple times will be disqualified. Entries which are incomplete, not legible, misappropriated, misdirected, received after than the Competition End Date, or otherwise not in compliance with these Rules will be disqualified and the Corporate Participant and TopCoder will have no responsibility for such entries.
IN ORDER TO BE ELIGIBLE, YOU WARRANT THAT YOUR SUBMISSION:
- Does not include or anticipate the inclusion of any unsuitable or offensive content, including nudity, sexually explicit, disparaging, libelous or other inappropriate content.
- Does not include or anticipate the inclusion of any content that is in violation of or infringes third party intellectual property rights including, but not limited to copyrights, including music copyrights, trademarks, and rights of publicity.
- Has not been entered in previous contests, or won previous awards.
- Has not been published or distributed previously in any media.
- Is suitable for a general audience;
- Does not contain any claims that are not and cannot be substantiated or that would be false and/or misleading to a reasonable consumer.
All decisions relating to the viability of Submissions, the ranking of Submissions and all other matters pertaining to the Competition are within the sole discretion of TopCoder or its designee and shall be final and binding in all respects.
How to participate

2. Develop a new application.

4. Winners will be selected based on the judging criteria below. The winning entries will be announced on the date stated in the Competition documentation.

JUDGING CRITERIA:
Submissions will be judged by the Competition judging team. Only applications using the Specified Technology and submitted before the submission period closes will be considered. Submissions will be evaluated according to the following criteria:
- 25% API Usage – Proper and effective usage of the Specified Technology.
- 25% Appeal – Application appeal including usefulness of concept, quality of user experience, and visual design.
- 25% Implementation – Code quality and conventions as well as proper usage of platform technologies. Commented code is important, particularly around the usage of the Specified Technology, because the submission is intended to become sample code for the Open API Service website.
- 25% Functionality – Functionality of the application including breadth and quality of application features, application flow and organization.
The judges will have the sole authority and discretion to select the winner(s). TopCoder’s decision concerning any disputes, the Rules and any other matter concerning the Competition is final and binding, without further correspondence or discussion.
SELECTION OF WINNER(S)/ AWARDING OF PRIZE(S):
The Competition judges will select the name(s) of the winners from among all eligible entries received. Decisions of the judges are final and binding.
All prizes will be awarded, provided a qualified number of entries are received. If a winner cannot or will not accept a prize, then the prize will be forfeited and awarded to the next highest scoring entry.
Winners of this Competition will be contacted via e-mail. Unless otherwise provided herein, by participating in this Competition, You acknowledge and agree that if your submission is selected as a winner, You will receive a cash award only upon verification of all applicable eligibility requirements. All prize values are stated in US dollars. Cash prizes will be paid out by TopCoder (or its designee) in the US in US dollars no later than 90 days following prize notification. Taxes, if any, are the sole responsibility of the winner(s).
PRIVACY
All information is collected in the United States, and the use of any personally identifiable information is subject to the terms of the TopCoder Privacy Statement located at: http://www.topcoder.com/tc?module=Static&d1=about&d2=privacy
ORIGINAL WORK/LEGAL COMPLIANCE
By submitting an entry, You represent that such entry is your own, original work. An entry may be disqualified if TopCoder or the Corporate Participant believes in their sole discretion that such entry does not comply with these Terms and Conditions, infringes or violates the rights of any third party, contains inappropriate content, or is in violation of any law or regulation.
PERMISSION TO DISPLAY AND LINK TO SUBMISSION.
As consideration for participating in the Competition, submission of an entry constitutes permission for TopCoder and the Corporate Participant to use Your name, address, likeness and general information about the winning entry submitted by You for promotional and advertising purposes without further permission or compensation.
LICENSE TO WINNING SUBMISSIONS
Competitors retain all ownership rights in their Submissions. However, if TopCoder compensates You for your Submission, You hereby grant and agree to grant a perpetual, royalty-free, irrevocable, transferable, sub-licensable, non-exclusive license to TopCoder (a) to use, reproduce and publish Submissions or material in connection with the Competition; (b) to publicly display, and/or feature your Submission and all its content in connection with the promotion of the Competition in all media (now known or later developed); and (c) store your Submission on TopCoder’s servers, for marketing purposes, and/or for the promotion of the Competition. You agree to sign any necessary documentation that may be required by TopCoder or its designees to make use of the rights you granted above.
Nothing in these Rules shall be construed as granting you any right or license under any intellectual property right of TopCoder or any Competition sponsor(s) (including any rights they may have in any patents, copyrights, trademarks, service marks or any trade secrets) or in TopCoder’s web site, by implication, estoppel or otherwise, except as may be expressly set forth herein.
NO ADDITIONAL RIGHTS FROM SUBMISSION.
By participating in the Competition, You acknowledge and agree that it is possible that others, including TopCoder and/or Corporate Participant, may have developed or develop applications that are similar in function, appearance, action, name, character, or in other ways appear to resemble the entry submitted, and that such duplication or similarity between Your entry and any other’s shall in no way entitle You to any compensation from TopCoder, the Corporate Participant, or any third party.
CONDUCT OF COMPETITION.
TopCoder and the Corporate Participant reserve the right, in their sole discretion, to revoke any and all privileges associated with competing in this Competition, and to take any other action they deem appropriate, for no reason or any reason whatsoever, including if TopCoder or a Corporate Participant suspect competitors of cheating, tampering with the entry process, the operation of the Web site, or the Competition process, or otherwise being in violation of the rules.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, TOPCODER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
DISCLAIMER
By participating in the Competition and/or acceptance of a prize, You acknowledge and agree that Corporate Participant and TopCoder, their affiliates, directors, employees and agents shall not be liable for, and will be held harmless by and against any liability for any damage, injury or loss to person or property due in whole or in part, directly or indirectly to acceptance, possession or use or misuse of a Competition entry, Competition prize, participation in any Competition related activity, or other rights granted herein or participation in this Competition.
By participating in this Competition, You agree, where legally permitted, to release and hold harmless TopCoder, the Corporate Participant and their respective subsidiaries, affiliates, advertising and promotions agencies, prize suppliers, and all of their employees, officers, directors, shareholders and agents (collectively “Releasees”) from and against any and all liability for any loss, property damage, or damage to any person, including without limitation, death and injury, due in whole or in part, directly or indirectly, from or arising out of participation in this Competition or any related activity, or the receipt, use or misuse of any prize. TopCoder and the Corporate Participant specifically disclaim all liability associated with, and make no warranties with regard to, any prize given.
Releasees assume no responsibility for lost, late, illegible, garbled or misdirected entries, or for any computer, online, telephone, human, or other error or for any technical or other malfunctions that may occur including any injury or damage to Your or any other person’s computer relating to or resulting from participation in this Competition or downloading any materials in connection with this Competition.
If for any reason this Competition is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, uploads of malicious files or viruses, or any other causes beyond the reasonable control of TopCoder or the Corporate Participant which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Competition, TopCoder and the Corporate Participant reserve the right at their sole discretion, to disqualify any entry or any individual who tampers with the entry or judging process, and to cancel, terminate, modify or suspend this Competition and select winners using all eligible, non-suspect entries received as of the date of termination. Releasees assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries.
In those states which do not allow the limitation of liability or exclusion of liability for incidental or consequential damages; the above limitations may not apply.
THIRD PARTY SERVICES/COPYRIGHT NOTICE:
You agree to be bound by all applicable terms and conditions governing access to TopCoder, Corporate Participant, or third party services. All technologies and Competition related functionality, media and promotional materials are the intellectual property of either the Corporate Participant or TopCoder and are protected by applicable copyright, trademark, patent and related proprietary laws.
WARRANTY AND INDEMNIFICATION:
You must not cheat, and must submit your own, original work. You warrant to TopCoder and the Corporate Participant that your entry is original, that you are the creator and owner of the submitted entry, that you have the unencumbered right to submit the entry, that the entry does not infringe any proprietary, intellectual property, personal rights or other third party rights including copyright, trademark, patent, trade secret or confidentiality obligation and is in compliance with applicable law. To the maximum extent permitted by law, You agree to indemnify and hold Corporate Participant and TopCoder, their subsidiaries, affiliates, and their employees, agents and directors harmless from any third party claim arising from the act, default or omission of You pertaining to the Competition and breach of any warranty set forth herein.
TAXES/EXPENSES:
You are solely responsible for any and all taxes, costs, and expenses associated with the receipt of or use of any prize, including duties (where applicable).
MISCELLANEOUS
Participation in this Competition is void where prohibited by law. If any provision of these Rules is held to be invalid or unenforceable, all remaining provisions will remain in full force and effect. This Competition is subject to and governed by the laws of the United States and the State of Connecticut. You agree that in no event shall You have the right to enjoin or prevent the production, distribution, exhibition, use, advertising or promotion of the submission, Corporate Participant technology or related and or derivative applications or products. TopCoder reserves the right, in its sole discretion, to revoke any and all privileges associated with competing in the Competition.
